BrandLink Subscription Terms

These Terms and Conditions (“Terms”) govern your use of the BrandLink Brand Portal subscription (“Subscription”) offered by Catch Light Productions (“we,” “us,” or “our”). By accessing or using the Subscription, you agree to be bound by these Terms. If you do not agree to these Terms, please do not purchase the Subscription.

Definitions

“Service” means the BrandLink Brand Portal made available by us for your use during the Subscription.
“Subscription” means the period during which you may use the Service while paying the recurring monthly fee.
“You” or “your” means the individual or company using the Subscription.

Use of the Service during Subscription

Eligibility: The Subscription is only available to individuals who are at least 18 years old and capable of forming a binding contract.
Access: You have unlimited access to the Service during the Subscription period.
Usage: You may use the Service only for the company or organization signed up for the Service.
Restrictions: You may not:

Use the Service for other companies or organizations or resell the Service.
Modify, reverse-engineer, or attempt to derive source code from the Service.
Disclose, share, or distribute the Service or its output to any third party.

Subscription Period and Termination

Duration: The Subscription period begins on the date after you sign up and will continue on a monthly basis until you cancel or your account is terminated.
Cancellation: You may cancel the Subscription at any time by contacting us here.
Termination: The Subscription will automatically terminate at the end of the Subscription period when you request cancellation, within five days of non-payment for any month, or if you are found to be in violation of these Terms.

Payments

First Payment: Your credit card will be charged upon signing up for the Service
Recurring Payments: Your credit card will automatically be charged for the recurring payment each month for the duration of the Subscription.

Intellectual Property

Ownership: We retain all rights, title, and interest in and to the Service, including all intellectual property rights.
License: We grant you a limited, non-exclusive, non-transferable license to use the Service during the Subscription period.

Guarantee and Limitation of Liability

Guarantee: THE SUBSCRIPTION SERVICE IS PROVIDED WITH FULL SUPPORT AND GUARANTEE OF SERVICE UPTIME, EXCEPT FOR SCHEDULED MAINTENANCE OR INCIDENTS BEYOND OUR CONTROL.
Limitation of Liability: IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SUBSCRIPTION OF THE SERVICE.

Governing Law and Jurisdiction

Governing Law: These Terms will be governed by and construed in accordance with the laws of Texas, United States.
Jurisdiction: Any disputes arising from or related to these Terms will be resolved through binding arbitration before a mutually agreed-upon Arbitrator.

Changes to Terms

We reserve the right to modify these Terms at any time, with or without notice. Your continued use of the Subscription for the Service after changes to these Terms will be deemed acceptance of the modified Terms.

Acceptance

By using the Subscription or the Service, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Subscription or the Service.
